Tailoring Trial Advocacy for Mediation.

This material provides an in-depth examination of proceeding into mediation with the purpose of tailoring the anticipated trial advocacy to the audience and process of mediation. 

Trial lawyers can be excellent in mediation for the same reason that combat generals can be successful peacemakers. Both know the waste and cost of prolonged conflict, have proven they are unafraid of the ultimate fight in the right circumstances, and can rationally balance options to avoid a confrontation. For this reason, the lead trial counsel should almost always attend the mediation. The other side needs to see what they face if the mediation is unsuccessful. If trial counsel does not attend the mediation, she or he is diminishing its chance for success—and cheating the client.
