This program evaluates various models of binding arbitration and makes recommendations for its application in a variety of commercial matters, including distributor agreements, and addresses how arbitration differs from trial. Finally, it will address the recent phenomenon of class arbitration.

Commercial Arbitration has its roots in the 12th Century Renaissance when the growing commercial guilds opted to privately resolve their disputes among themselves rather than resort to the ecclesiastical courts.
